Former Bungoma Governor Wycliffe Wangamati

BUNGOMA, Kenya
The Ethics and Anti-Corruption Commission (EACC) has recommended the prosecution of former Bungoma Governor Wycliffe Wangamati and Webuye West MP Dan Sitati Wanyama over the alleged embezzlement of more than Sh70 million through irregular road tenders.
In its report to the Office of the Director of Public Prosecutions (ODPP), EACC alleges the funds were siphoned between 2017 and 2021 through companies owned by Wangamati’s brothers and close associates.
One of the firms, Nabwala Construction Co. Ltd is said to have received Sh37 million.
The commission has proposed charges of abuse of office, conflict of interest, flouting procurement laws and acquisition of proceeds of crime.
Several contractors including Nasikhab Civil Contractors Ltd, Fastec Supplies Ltd, Valeria Construction Ltd, Kelco Builders Ltd and Nabweso Builders Ltd are also implicated.
EACC investigators said the firms were newly registered lacked experience and used falsified documents to win tenders.
The probe began in November 2021 following reports that Wangamati and county officials colluded to loot public funds.
Bungoma Senator Wafula Wakoli on Saturday welcomed the development, insisting that the Senate would continue its oversight role without intimidation.
“Nobody will tell us how to do our work. Those found guilty must face justice,” Wakoli said.
Residents have also backed the anti-graft body.
Webuye West resident Isaac Wanjecheke urged President William Ruto to extend investigations to the ruling United Democratic Alliance (UDA), where Wanyama is a member.
“We are happy the file is already with ODPP. Prosecuting them will set an example,” he said.
The ODPP is expected to decide whether formal charges will be filed.
